1. Introduction

Welcome to Hiflex (also referred to as "we", "our", or "us"). These Terms and Conditions ("Terms") govern your use of our website, repair and maintenance services, on-site support, data recovery, and other related services (collectively "Services"). By accessing or using our Services you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Definitions

For the purposes of these Terms:

  • "Customer" or "you" means any person or entity using or receiving our Services.
  • "Device" means any laptop, desktop, server, storage device, or other hardware submitted to Hiflex for service.
  • "Works" means repair, diagnostics, data recovery, replacement parts, software services, and other services rendered by Hiflex.

3. Scope of Services

We provide diagnostic, repair, component-level and chip-level motherboard services, data recovery, maintenance, and on-site services. Specific service details, estimated timelines, and costs will be provided in estimates, service orders, or quotations prior to commencement when applicable.

4. Service Requests, Estimates and Authorization

All service requests must be authorized by the Customer. Estimates provided are indicative and may change based on further diagnostics. By authorizing work, the Customer permits Hiflex to perform necessary diagnostics and repairs. Additional or out-of-scope work will be communicated for approval before proceeding where practicable.

5. Pricing and Payment

Prices for services and parts will be set out in estimates or invoices. Payment terms are as specified on the invoice. Unless agreed otherwise, full payment is due upon completion of service and prior to release of the Device. We accept payment via the payment methods listed on our website or as otherwise agreed.

6. Parts and Warranties

Where replacement parts are used, they may be new, refurbished, or equivalent to original manufacturer specifications; we will disclose the type of parts used on request. Hiflex provides limited warranties on replaced parts and workmanship as communicated at the time of service; warranty terms vary by service and part type. Warranties do not cover damage resulting from misuse, accidents, unauthorized modifications, or exposure to liquids, fire, or other external causes.

7. Data, Backups and Privacy

Customers are strongly advised to maintain their own backups. While we take reasonable care during diagnostics and repair, Hiflex is not responsible for lost, corrupted, or missing data arising from repair activities unless expressly stated in a separate written agreement. We will handle Customer data in accordance with applicable data protection laws and our privacy practices. Please see our Privacy Policy for details.

8. Confidentiality

We will treat Customer information and any confidential data encountered during service as confidential and will not disclose it except as required by law or with the Customer's consent. However, we cannot guarantee confidentiality of data stored on Devices when access is necessary for diagnostics and repair.

9. Access and On-site Services

For on-site services, the Customer must provide safe and lawful access to premises, power, and workspace. Hiflex personnel will comply with site-specific safety and security requirements. Any delays or additional costs caused by site conditions are the Customer's responsibility.

10. Customer Obligations

Customers must:

  • Provide accurate contact and device information;
  • Disclose any passwords, encryption, or security measures necessary to access the Device for diagnostics (you may remove passwords where appropriate);
  • Remove any personal items from Devices and disclose any physical damage or hazards;
  • Ensure that providing the Device for repair does not violate any third-party rights or licenses.

11. Intellectual Property

All intellectual property rights in the Services, reports, repair processes, and any documentation provided by Hiflex remain the property of Hiflex or its licensors unless otherwise agreed in writing. Customers retain ownership of their Devices and the data stored on them, subject to these Terms.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Hiflex's total liability arising from or related to the Services (whether in contract, tort including negligence, or otherwise) shall not exceed the amount paid by the Customer for the specific service that gave rise to the claim. Hiflex is not liable for:

  • Indirect, incidental, special, or consequential losses, including loss of profit, business interruption, or loss of data;
  • Loss or damage caused by third-party parts, unauthorized modifications, or pre-existing defects;
  • Losses due to delays caused by parts availability, third-party suppliers, or transport.

13. Indemnity

The Customer agrees to indemnify and hold Hiflex harmless from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from the Customer’s breach of these Terms, the Customer’s negligence, or misuse of Services.

14. Collection, Storage and Disposal

Devices left uncollected beyond any specified collection period may be subject to storage charges. If uncollected after reasonable notice, Hiflex may dispose of or sell the Device in accordance with applicable law. Any proceeds from such sale may be applied toward outstanding fees.

15. Termination

Hiflex may suspend or terminate services where the Customer breaches these Terms, fails to pay fees, or where continuation of service would be unlawful or unsafe. Termination does not affect accrued rights or obligations.

16. Changes to Terms

We may modify these Terms from time to time. Updated Terms will be posted on our website with a revised "Last updated" date. Continued use of Services after such updates constitutes acceptance of the revised Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India, unless otherwise agreed in writing.

18. Force Majeure

Hiflex is not liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, governmental actions, acts of terrorism, pandemics, or supply-chain disruptions.

19. Severability

Where any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed to the minimum extent necessary and the remaining provisions shall continue in full force and effect.
